These Terms of Service constitute a legally binding agreement between you and Avestan LLC, doing business as Reala ("Reala," "we," "us," and "our"), regarding your use of the platform, including all associated features, content, and services.

2. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to use our services. By using our services, you represent and warrant that you meet the eligibility requirements. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

3. User Accounts

When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

  • Provide accurate registration information
  • Maintain the security of your password
  • Notify us immediately of any unauthorized use
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair the service. Prohibited activities include but are not limited to:

  • Violating any applicable laws or regulations
  • Infringing on intellectual property rights
  • Transmitting malicious code or harmful content
  • Attempting to gain unauthorized access to systems
  • Interfering with or disrupting the service

5. SMS Messaging Terms

Reala SMS Notifications provide conversational real estate follow-up, appointment coordination, showing reminders, and related service updates from Reala or connected realtors.

By submitting a form, inquiry, or connected lead-source request with your phone number and SMS consent, you agree to receive text messages from Avestan LLC/Reala and connected realtors about your real estate inquiry.

Message frequency varies. Message and data rates may apply. Reply HELP for help. Reply STOP to opt out. For support, contact support@reala.agency.

Mobile carriers are not liable for delayed or undelivered messages.

Your consent to receive SMS messages is not a condition of purchasing any property, service, or product. You may opt out at any time by replying STOP.

6. Intellectual Property

All content, features, and functionality of our services are owned by Reala or its licensors and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the services will cease immediately.

8. Limitation of Liability

To the maximum extent permitted by law, Reala shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the services.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated terms on our platform. Your continued use of the services after changes constitutes acceptance of the modified terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Avestan LLC is incorporated, without regard to its conflict of law provisions.
